Biography For more than 20 years, Kevin Haroff has represented businesses, individuals and governmental entities in complex environmental law, civil litigation and regulatory enforcement cases. Kevin has handled a broad range of matters involving federal and state environmental statutes, and he has appeared before a variety of administrative agencies on environmental law and policy issues. More recently, Kevin has developed a national reputation on the subject of climate change, with respect to both current regulatory developments and climate change-related litigation. Chambers USA has consistently recognized Kevin Haroff as one of the leading environmental lawyers in California. Clients and colleagues describe Kevin as a “world-class . . . professional” who has provided “incredible expert opinions on complex environmental matters.” His “attention to execution on tough decisions makes him one of the best in the business.” Kevin is “a talented and trusted environmental, land use, and climate change lawyer with the strategic vision to advocate for his clients while understanding their business realities.” Kevin Haroff has spoken on environmental and natural resource topics at conferences held in California, throughout the United States and abroad. His speaking engagements have included presentations at the annual Asia Business Conference at Harvard University and the Euromoney Conference on Trade and Finance in Shanghai, China. Through these engagements and various writing projects, Kevin has “repeatedly demonstrated his commitment to furthering public dialogue about critical legal issues.” Kevin has a law degree from Cornell Law School. He has an undergraduate degree in philosophy and psychology from Cornell University's College of Arts and Sciences and a master's degree in business administration (with distinction) from Cornell's Johnson Graduate School of Management. Areas of Expertise Environmental Litigation - Kevin Haroff has represented clients on environmental matters in both federal and state trial and appellate courts, including matters under the federal Clean Water Act, the Clean Air Act, and the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). Among other things, Kevin represented a major California port in an environmental cost recovery and contribution action involving a former aeronautical manufacturing facility adjacent to the San Diego International Airport. He defended a high profile governmental enforcement action brought by the U.S. Department of Justice alleging substantial violations of the federal Safe Drinking Water Act by a retail water provider in Monterey County, California. Kevin represented an international pulp and paper company in an early court challenge to the adoption of water quality standards for toxic pollutants by the California State Water Resources Control Board. Land Use and Natural Resources - Kevin has advised and represented clients on a variety of land use and natural resource matters, with a substantial emphasis on water quality and supply issues in the western United States. He represented a major Northern California water supply agency in administrative proceedings and litigation over water supplies from the San Francisco Bay - Sacramento and San Joaquin River Delta (Bay Delta) and the California Central Valley Project. He represented residential and commercial development interests over municipal water supplies to one of the largest planned development projects in Northern California. Kevin also represented a civilian airport authority in connection with the public benefit transfer of a former Naval air station on Guam. Kevin is a recognized expert on land use processing and related issues under the California Environmental Quality Act (CEQA). Toxic Tort and Proposition 65 - Kevin has defended clients in complex toxic tort cases and a variety of matters brought under California’s Safe Drinking Water and Toxic Enforcement Act (Proposition 65). He successfully represented a client in federal court litigation asserting personal injury and fear-of-cancer claims in connection with alleged exposure to dioxin and other chemicals in local drinking water supplies. Unusually, the court dismissed the case in its entirety on a substantive motion for summary judgment, and the dismissal was upheld by the Ninth Circuit Court of Appeals in all respects. In Proposition 65 cases, Kevin has defended clients against claims of alleged unlawful exposures to lead, cadmium, mercury and other chemical substances (including second-hand smoke) in connection with a variety of different consumer products and exposure scenarios. Alternative Dispute Resolution - Kevin has been engaged frequently in connection with the mediation and arbitration of environmental and other types of disputes. Kevin was involved in one of the first arbitration proceedings convened to allocate environmental response liability under California’s hazardous waste control laws. He since has had substantial roles in private party mediations over environmental liability under CERCLA, groundwater contamination disputes, disputes over costs and pricing to dispose of municipal solid waste, arrangements for the provision of municipal water supplies, and environmental insurance disputes.
