The fiduciary’s duties are based on that trust, statutory law, regulations, court decisions, company codes of conduct, industry best practices, fiduciary standards and on the wording of a possible written agreement.
FIDUCIARY RATING: A quantitative judgement of fiduciary governance quality, based on an audit on the fiduciary risk or probability that (co)fiduciaries are unable to fulfill their duties towards beneficiaries, due to their non-compliance with the (un)written rules and procedures of fiduciary governance, and that they consequently are held liable for damages, caused by inadequate direction, management and control of the fiduciary process.
FIDUCIARY MANAGEMENT: aims to fulfil the duties of (principal) fiduciaries towards beneficiaries. Key elements are: (1) integrated asset-liability management, (2) hiring-and-firing of third parties, including (secondary) fiduciary managers, (3) information management to enhance transparency and beneficiary satisfaction, (4) management of conflicts of interest, (5) management of risk and compliance, (6) independent management oversight, and (7) achievement of the desired fiduciary governance level substantiated with quality assurance, external audit, and fiduciary rating.
